Will of John D. PRICE dec'd.
In the name of God, Amen.
I , John D. Price of the County of Belmont and State of Ohio, being of sound
and disposing mind and memory and understanding considering the uncertainty
of life do make this my last will and testament, in the manner following
that is to say,--
First. my will is that the expences (sic) of my last Sickness and funeral
be first paid.
Second: all just debts by me owing at the time of my death be paid.
Third. I give and devise to my daughter Jane in fee Simple the East half
of North West quarter of Section No. Thirty one Township Eight- Range Six,
also her choice of any Horse that I may have and gear for the Same. also one
Cow, one Bed and Furniture for the Same and Bureau one plough.
Fourth. I give and devise to my Daughter Elizabeth Jackson during her
natural life the West half of the North West quarter of Section No. thirty
One, Township Eight- Range Six, and after her decease, I give and devise the
same to my Grand Son George Jackson in fee Simple.
Fifth: I give and devise to my Son John Wesley Price, in fee Simple forty
six acres of land being a part of the North East half of quarter Section No.
Thirty two. Township Eight, Range Six. I also give and bequeath to my Son
John Wesley Price all my Books and Book Case
Sixth. I give and devise to my Grand Son Otho Barns Fifty Dollars to be
paid to him when he comes of age.
Seventh: I give and devise to the Family residing with me at my Homestead
at the time of my decease the provisions that I may have provided for that
season;
Eighth. The ballance (sic) of my personal property to be Sold and the
debts due me to be collected together with any money I may have on hand be
equally divided amongst my five Children to wit: John Wesley Price Nelson
Price, Eleanor Odell, Nancy Ransom, and Mary Reed
Ninth: lastly I do hereby constitute and appoint my two Sons, John Wesley
Price, Nelson Price of the County of Belmont and State of Ohio, to be the
Executors of this my last will and Testament, revoking annulling all former
wills by me heretofore made ratifying and confirming this.
In testimony whereof I have hereunto Set my hand and Seal, this twenty
third day of June in the year of our Lord Eighteen hundred and forty Six.

Signed Sealed published and delivered by John D. Price the above named
Testator as and for his last will and testament in the presence of us who at
his request, and in his presence have Subscribed our names and Witness
thereto.

Evidence
The State of Ohio. Belmont County SS, Court of Common Pleas Spring Term
A.D. 1851
As in Regular Term of the Court of Common Pleas of said County, begun and
held in the Court House of Said County, on the 17th day of March A.D.
1851... Joseph Hall one of the Subscribing Witnesses to a paper writing this
day presented to said Court for probate, purporting to be the last will and
testament of John D. Price late of Said County, deceased Came into Court,
and being Solemnly Sworn in open Court.
This Said Joseph Hall jr. for himself upon his Solemn Oath Saith, that he
Saw the Testator Sign the Said paper writing as and for his last will and
testament, that he Subscribed the Same as a Witness thereto in the presence
of the Testator and at his request; that the Testator at the time of Signing
was of Sound mind and memory. Twenty One years of age and not under any
restraint;
